CAPAC Demands President Trump Uphold Due Process

WASHINGTON, D.C. — The Congressional Asian Pacific American Caucus issued the following statement in response to the Trump administration’s unlawful actions targeting immigrants and refusal to uphold due process:

“Due process is not a suggestion or a privilege afforded to a select few — it is a fundamental right guaranteed to all under the United States Constitution. For over two centuries, this principle has ensured that no person — citizens and noncitizens alike — is deprived of life, liberty, or property without a fair trial. It is not up for debate. It is the law.

“Yet the Trump administration continues to ignore their constitutional duty, going so far as to defy federal court orders designed to uphold the rule of law. Legal U.S. residents are being detained, disappeared from their communities, and deported without due process. One such case is that of Kilmer Abrego Garcia, who is now trapped in a notorious prison in El Salvador due to what the government dismisses as an ‘administrative error.’ The administration has even considered the possibility of sending American citizens to the very same prison. 

“This is not just a legal crisis. It is a moral one. If the government can strip people of their rights and deport anyone without due process, then none of us are safe. That reality should terrify every American.

“While the Supreme Court has issued a ruling to temporarily halt illegal deportations, Congress must be prepared to act to uphold the rule of law. Every Member of Congress swore an oath to defend the Constitution, not only when it is easy or politically convenient, but especially when it is under attack. This is such a moment. We must stand united against this assault on the Constitution, our systems of checks and balances, and the rule of law.”
